Agreement
These Terms are an agreement between NOOBAITECH, Delhi, India (“we”, “us”) and the school or institution that registers for Bachpan Saathi (the “School”), and every person who uses the Service on the School's behalf. The Service means the Bachpan Saathi website, school web panel and mobile app. A school accepts these Terms and our Privacy Policy by ticking “I agree” when it registers. Staff, teachers, drivers and parents accept them by ticking “I agree” on the login screen, which is needed to log in; we record this on their first login. If you do not agree, do not use the Service.
The person who signs up confirms that they are at least 18 years old and authorised to accept these Terms for the School.
Accounts
- Give true and complete information at sign-up and keep it up to date. Email and mobile numbers are verified with one-time codes.
- Keep passwords and one-time codes secret. You are responsible for what happens under your School's account. Tell us at once at support@noobaitech.com if you think an account is misused.
- The main school admin controls which staff get a login and what each role can see and do.
School's responsibilities
For the records it keeps in Bachpan Saathi, the School is the Data Fiduciary under the Digital Personal Data Protection Act, 2023 and its Rules. The School will:
- Give notice to students, parents and staff about the personal data it collects and why, and obtain their consent where the law requires it — including verifiable consent of a parent or lawful guardian for children's data, unless a legal exemption applies;
- Enter only data that is needed for its educational, administrative and safety purposes, and keep it accurate;
- Handle requests from students, parents and staff to access, correct or erase their data, with our help where needed;
- Not upload sensitive identifiers (such as Aadhaar numbers, health or bank details) unless the law requires it;
- Follow all laws that apply to it, including education, tax and data protection laws.
Data and privacy
- The School owns its data. It gives us permission to store and process that data only to provide, secure and support the Service. For this data we act as the School's Data Processor and follow the School's instructions and our Privacy Policy.
- We keep the data confidential, protect it with reasonable security safeguards, use service providers only under written obligations, and tell the School without delay about any personal data breach that affects it.
- The School can export or delete its records. When the account is closed, we delete or anonymise the School's personal data within 90 days, except what the law requires us to keep.
Acceptable use
You must not:
- Upload anything unlawful, harmful, abusive, obscene or that infringes someone else's rights, including photos of children that are not appropriate;
- Use the Service to send spam or messages the recipients did not expect from their school;
- Try to access another school's data, break or bypass security, overload the Service, or copy, reverse-engineer or resell it;
- Share your login with people outside your School.
Plans and payments
- Features and limits depend on the School's plan. Current plans, prices and taxes are shown in the school web panel before purchase.
- Payments are processed by our payment partner. Prices include or add GST as shown at checkout, and an invoice is issued for every payment.
- Unless a plan says otherwise, fees already paid are not refundable for a partly used period. If a payment fails or a plan ends, some features may be limited until the plan is renewed; the School's data is not deleted because of this.
The Service
- We work to keep the Service available and secure, but it may sometimes be interrupted for maintenance, updates or reasons outside our control.
- We may add, change or remove features. If we remove an important paid feature, we will tell the School in advance.
- Some features rely on third parties (for example email, push notifications, app stores and payment partners) and are subject to their availability.
Intellectual property
The Service, the Bachpan Saathi name and logo, and all software and designs belong to NOOBAITECH. We give the School a limited, non-exclusive, non-transferable right to use the Service for its own school while these Terms apply.
Suspension and closing
- The School may stop using the Service and ask us to close its account at any time.
- We may suspend or close an account if these Terms are seriously broken, if the law requires it, or to protect students, users or the Service. Where reasonable, we will give notice and time to fix the problem first.
- After closing, the School can ask for an export of its data within 30 days; then the data is deleted as described in section 4.
Disclaimers and liability
- The Service is provided “as is”. The School remains responsible for checking important records such as fees, salary and results.
- To the extent the law allows, we are not liable for indirect or consequential loss, such as loss of profit or reputation.
- To the extent the law allows, our total liability for any claim is limited to the fees the School paid us in the 12 months before the claim.
- Nothing in these Terms limits any right that cannot be limited under Indian law.
Indemnity
The School will compensate us for claims and losses caused by content it uploads, by its failure to obtain required notice or consent, or by its breach of these Terms or the law.
Law and disputes
These Terms are governed by the laws of India. We will first try to settle any dispute by talking with you. If that fails, the courts at Delhi, India will have exclusive jurisdiction. Privacy complaints can also be taken to the Data Protection Board of India as described in our Privacy Policy.
Changes
We may update these Terms. The new version and date will be shown here. For important changes we will notify the School, and the new version is recorded at each user's next login; continuing to use the Service after that means you accept the new Terms.
